CaliforniaCivilCodeSection1793.2(d)requiresthat,ifamanufacturer
oritsrepresentativeisunabletorepairamotorvehicletoconformtothe
vehicle’sapplicableexpresswarrantyafterareasonablenumberof
attempts,themanufacturershallberequiredtoeitherreplacethe
vehiclewithonesubstantiallyidenticalorrepurchasethevehicleand
reimbursethebuyerinanamountequaltotheactualpricepaidor
payablebytheconsumer(lessareasonableallowanceforconsumer
use).Theconsumerhastherighttochoosewhethertoreceivearefund
orreplacementvehicle.
CaliforniaCivilCodeSection1793.22(b)presumesthatthemanufacturer
hashadareasonablenumberofattemptstoconformthevehicletoits
applicableexpresswarrantiesif,withinthefirst18monthsofownership
ofanewvehicleorthefirst18,000miles(29,000km),whicheveroccurs
first:

Twoormorerepairattemptsaremadeonthesamenon-conformity
likelytocausedeathorseriousbodilyinjuryOR
2.
Fourormorerepairattemptsaremadeonthesamenonconformity(a
defectorconditionthatsubstantiallyimpairstheuse,valueorsafetyof
thevehicle)OR
3.
Thevehicleisoutofserviceforrepairofnonconformitiesforatotalof
morethan30calendardays(notnecessarilyallatonetime)
Inthecaseof1or2above,theconsumermustalsonotifythe
manufactureroftheneedfortherepairofthenonconformityatthe
