allowedafinalrepairattemptinsomestates.
IntheUnitedStates,awarrantydisputemustbesubmittedtothe
DisputeSettlementBoardbeforetakingactionundertheMagnuson-Moss
WarrantyAct,ortotheextentallowedbystatelaw,beforepursuing
replacementorrepurchaseremediesprovidedbycertainstatelaws.This
disputehandlingprocedureisnotrequiredpriortoenforcingstate
createdrightsorotherrightswhichareindependentofthe
Magnuson-MossWarrantyActorstatereplacementorrepurchaselaws.
IN CALIFORNIA (U.S. ONLY)
CaliforniaCivilCodeSection1793.2(d)requiresthat,ifamanufacturer
oritsrepresentativeisunabletorepairamotorvehicletoconformtothe
vehicle’sapplicableexpresswarrantyafterareasonablenumberof
attempts,themanufacturershallberequiredtoeitherreplacethe
vehiclewithonesubstantiallyidenticalorrepurchasethevehicleand
reimbursethebuyerinanamountequaltotheactualpricepaidor
payablebytheconsumer(lessareasonableallowanceforconsumer
use).Theconsumerhastherighttochoosewhethertoreceivearefund
orreplacementvehicle.
CaliforniaCivilCodeSection1793.22(b)presumesthatthemanufacturer
hashadareasonablenumberofattemptstoconformthevehicletoits
applicableexpresswarrantiesif,withinthefirst18monthsofownership
ofanewvehicleorthefirst18,000miles(29,000km),whicheveroccurs
